Who provides the service
Henrique Santiago Carrageis Ribeiro, in Lisbon, reachable at [email protected].
What this site is
A presentation of the service. The plan prices are the ones I charge, and I don’t add VAT on top of them. What falls outside them (pages above the number included, new features, brand work and everything in the Custom plan) is quoted separately and put in writing before starting.
Deadlines
Between one and three weeks, depending on the size of the site, counted from the delivery of all the material needed. The deadline is suspended while material or an approval from the client is missing, and changes asked for after the structure has been approved may add days to it.
Payment
The build is paid in two halves: €375 to start, which is what marks the start of the work, and the remaining €375 on delivery, before the site goes live. Before each half there is a stopping point: I deliver the structure and the message in writing before designing anything, and if at that point you don’t want to go on, I refund the first €375 in full, within eight days, with nothing more to pay; if brand work has already been delivered, that is paid for and the files are yours, and it is the only thing not included in the refund; the second half is only due after you have seen the site working. The first monthly fee goes with that second half, because delivery is when the domain and the hosting start being paid for; from then on it renews on the same day each month. Invoices are paid within eight days. The prices shown are what you pay: I don’t add VAT on top. If a monthly fee goes unpaid, I warn you first and keep the site online; after thirty days without settlement, I suspend it until it is paid, without deleting anything.
The logo
Putting online the logo the business already has as a vector file (SVG, AI, EPS or a vector PDF) is included in the build price, with the versions for light and dark backgrounds and the icon for the browser tab. If only an image of the logo exists, redrawing it as a vector costs €60, once, included in the Pro, Max and Custom plans. What is included is the vectorisation work, not a result the source file does not allow: subject to the right of refusal described below, its inclusion in the plan gives no right to a different result. If there is no logo at all, one is made, and it costs €250, once, whatever the plan: the site does not go live without it, because the logo appears in the header, in the browser tab, on the Google profile and on social media. That work includes two directions to choose from and one round of changes on the chosen one, and delivers SVG and PNG for light and dark backgrounds, in horizontal and stacked layouts, with the icon, the minimum size and the clear space. The full visual identity (logo and variants, colours, typefaces, graphic elements, the agreed applications and a usage manual) costs €750, once, and deducts the €250 of a logo I made and the client paid for in the previous twelve months. The identity chooses the brand’s typefaces and leaves the client licensed to use them; designing a typeface from scratch is a different job and is not included, nor at this price. I reserve the right to refuse to vectorise a logo that cannot become a vector without losing its character, namely one with gradients, shadows, textures or a drawing generated by artificial intelligence; in that case I give the reason in writing, nothing is charged for the refusal and I propose creating a new logo. Logos with coats of arms, illustrations or similar detail are quoted separately, and that is said before starting. These amounts are paid with the first half of the build, because the logo has to be ready before the site is designed, and none of them is charged without being accepted in writing. If you stop at the first stopping point, I refund the €375 of the build; brand work already delivered is not refunded and the files belong to the business, with all rights of use, once paid. Registering the trademark with INPI, the Portuguese trademark office, is a separate process, paid to INPI, and is not included.
Right of withdrawal
The right of withdrawal is a consumer’s right, that is, of a natural person contracting for purposes outside their trade or profession. Whoever contracts for their business is not in that position, and what applies are the two stopping points described under Payment. If the client is a consumer and the contract was concluded at a distance or away from my premises, they may withdraw from it within 14 days of its conclusion, without giving a reason and without bearing costs, simply by saying so to [email protected]. I refund everything I have received within 14 days. Work does not start within that period without an express request; with that request, a withdrawal partway through pays the share proportional to what has been done, and the right ends if the service is fully provided within the period. The withdrawal form comes with the contract, in Annex C.
Who owns what is made
The domain is registered in the business’s name. The copy, the photos and the delivered site belong to the business once paid. I may show the work in my portfolio; if you’d rather I didn’t, just say so.
What I need from you
Up-to-date information, photos, opening hours, contact details and an idea of what sets the business apart. If the material arrives late, the deadline moves by the same amount of time.
Hosting and maintenance
After delivery, the site moves to a monthly fee: €90 on Essential, €240 on Pro and €330 on Max. The €90 exists in every plan and covers hosting, domain registration, updates, fault repair and one hour a month of content changes, counted in half hours and not carried over to the next month. Beyond that hour it is €30 an hour, with the amount stated first. What separates the plans is the booking system, the management of social media and the management of the Google profile, with the scope described in each. Social media is counted by fortnight: I deliver three post proposals and publish up to three, from those the client approves. The same piece published on both networks counts as one post, and the number is a ceiling, not a minimum: in fortnights with no material or approval nothing goes out, and what does not go out does not carry over to the next fortnight. Each proposal gets one round of changes, asked for in one go within two business days of my sending it, and none goes out without the client’s approval. A client who prefers not to approve piece by piece can sign up for autonomous management: I publish without asking for approval, the client has taken down whatever they don’t want online, and there is no compensation for the brand’s image. If a piece is rejected outright, I replace it with another, once a fortnight. A second round of changes on the same piece, a second replacement in the same fortnight or posts above three are separate work, at €30 an hour counted in half hours: I say first what it costs and only go ahead after the client accepts in writing. Each plan includes a maximum number of pages: five on Essential, eight on Pro and twelve on Max, with no limit on the Custom plan. Pages above that number, like new features, are quoted separately. You can move up a plan at any time, effective the following month; moving down is only possible after the initial twelve months, also effective the following month. Alternatively you can pay the year up front, with one month free: €990, €2,640 or €3,630, that is €90, €240 or €330 less than paying month by month. If you end the contract partway through a year already paid, I refund what was paid minus the months already started, each at the list monthly price: whoever leaves mid-year loses the discount for paying yearly. Email notices and confirmations are included in every plan; SMS campaigns run on the client’s account, who buys the credits, and can only be sent to people who have given permission. The monthly fee has an initial period of twelve months from delivery; after that period, it ends with thirty days' notice from either side, with no penalty and no reason needed. That period is why the build costs €750 instead of €1,500. Leaving before those twelve months are over, you pay the lower of two amounts: the €750 discount in proportion to the months left, or half of the monthly fees left, and the same applies if the contract ends for non-payment. Without the initial period, the build costs €1,500 and the monthly fee ends with thirty days' notice from the start. Nothing is payable if the exit is due to a breach on my part, to a price update you don’t accept or to having stopped at the first stopping point. After the first year, the monthly fee may be updated, at most once a year, if the costs the service depends on go up (hosting, domains, email sending, tools) or to keep up with inflation. It is not automatic: without a notice, the price stays the same. With one, I give sixty days' notice and state the reason, and whoever does not accept leaves without paying anything for it. The build price does not change with any of these things.
Applicable law
Portuguese law applies. In a consumer dispute, you can turn to an alternative dispute resolution body: Centro de Arbitragem de Conflitos de Consumo de Lisboa, the consumer arbitration centre for the Lisbon Metropolitan Area, which includes Oeiras, for disputes up to €5,000: centroarbitragemlisboa.pt, 218 807 030. My services are meant for businesses, so this route exists for anyone contracting as a consumer.
